What’s in these terms

These terms set out the rules for using the PurAI Chat technical support chatbot available at: https://www.purpakgroup.com/support/ (the “Chatbot”).

By using the Chatbot, you confirm that you accept these terms of service and that you agree to comply with them.

If you do not agree to these terms, you must not use the Chatbot.

We amend these terms from time to time. You should check these terms each time you use the Chatbot.

 

We may make change or withdraw the Chatbot

The Chatbot is provided on a beta basis.

We may update, change, suspend, restrict or withdraw the Chatbot, in whole or in part, at any time and without notice.

We do not guarantee that the Chatbot will always be available, uninterrupted, secure, or free from errors.

You are also responsible for ensuring that anyone who uses the Chatbot through your internet connection is aware of these terms and complies with them.

 

Key Terms of Use

 

1. Nature of the Chatbot

1.1. The Chatbot is an AI-powered tool designed to provide general technical information and guidance relating to PurPak equipment.

1.2. The Chatbot:

1.2.1. is provided for general information only;

1.2.2. is intended to supplement, and not replace, manuals, training, warnings, safety procedures, competent supervision or professional advice;

1.2.3. does not take into account your specific circumstances, environment, equipment condition, maintenance history, site layout or configuration; and

1.2.4. is not a substitute for a qualified engineer, technician or other appropriately trained professional.

 

2. Use of artificial intelligence

2.1. The Chatbot is an automated system powered by artificial intelligence.

2.2. You acknowledge that:

2.2.1. you are interacting with software and not a human;

2.2.2. responses are generated automatically;

2.2.3. no qualified engineer reviews responses before they are provided; and

2.2.4. because the Chatbot is provided on a beta basis, responses may be incomplete, inaccurate, out of date, inappropriate or unavailable.

2.3. The Chatbot may not identify when a question raises a safety-critical issue or when additional information is required to give reliable guidance.

 

3. Safety and proper use

3.1. Safety must always be your priority.

3.2. You must:

3.2.1. follow all relevant manuals, warnings, labels, instructions and safety procedures;

3.2.2. ensure that only trained personnel operate machinery;

3.2.3. ensure that any work requiring tools, access to internal components or safety guarding is carried out by appropriately qualified personnel; and

3.2.4. stop immediately and seek assistance from a qualified engineer or contact PurPak if:
• you are unsure about any response;
• the issues involved guarding, internal components, electrical or pneumatic systems, lock-out or isolation procedures, or any other safety-critical matter; or
• the Chatbot’s response conflicts with any manual, warning, label, training material or site procedure.

3.3. You must not:

3.3.1. Rely on the Chatbot to override manuals, warnings, training, safety procudres or professional judgment;

3.3.2. attempt repairs or adjustments beyond your competence

3.3.3. use the Chatbot to carry out unsafe activities; or

3.3.4. continue to use machinery where doing so may create a health and safety risk.

 

4. Do not rely on the Chatbot

4.1. The Chatbot does not provide engineering advice, health and safety advice, or any other professional advice.

4.2. You must independently verify any information provided before acting on it.

4.3. Any output generated by the Chatbot is provided “as is” and for general informational purposes only.

4.4. You are solely responsible for:

4.4.1. assessing the accuracy and suitability of any information provided;

4.4.2. any actions taken based on that information; and

4.4.3. the safe operation, maintenance, repair and use of any equipment.

4.5. Use of equipment remains at your own risk and responsibility, subject always to any liability which cannot lawfully be excluded or limited.

 

5. Acceptable use

5.1. You must use the Chatbot only for lawful purposes and in accordance with these terms.

5.2. You must not:

5.2.1. seek instructions for unsafe or prohibited activities;

5.2.2. misuse the Chatbot or attempt to interfere with its operation; or

5.2.3. input false or misleading information or incomplete information in circumstances where that may affect the response;

5.2.4. introduce viruses, trojans, worms, logic bombs or other malicious or technologically harmful material;

5.2.5. attempt to gain unauthorised access to the Chatbot, the server on which it is stored, or any server, computer or database connected to it;

5.2.6. attempt to probe, test, circumvent or undermine the Chatbot’s safeguards, restrictions or security;

5.2.7. use the Chatbot to generate content that is unsafe, abusive, unlawful, defamatory, infringing or otherwise objectionable; or

5.2.8. use the Chatbot in a manner which could damage, disable, overburden or impair the Chatbot or interfere with any other user’s use of it.

5.3. You must not input into the Chatbot:

5.3.1. confidential information;

5.3.2. trade secrets or other commercially sensitive information;

5.3.3. personal data, except where strictly necessary for your enquiry; or

5.3.4. any information which you do not have the right to disclose.

5.4. We may suspend, restrict or terminate your access to the Chatbot at any time if we reasonably believe that you have breached these terms, have misused the Chatbot, or that continued access may create legal, operational or safety risk.

5.5. We also have the right to disclose your identity where required to comply with legal obligations or in response to valid claims that content of the Chatbot infringes third party rights.

 

6. Intellectual property and outputs

6.1. The Chatbot, and all intellectual property rights in it, belong to us or our licensors.

6.2. Nothing in these terms transfers any intellectual property rights in the Chatbot or our website to you.

6.3. You may use outputs generated by the Chatbot only for your own internal informational purposes in connection with PurPak equipment.

6.4. You must not reproduce, publish, redistribute, exploit or use any output generated by the Chatbot for commercial purposes without our prior written consent.

6.5. We do not warrant that any output generated by the Chatbot:

6.5.1. is owned by you;

6.5.2. is available for exclusive use by you; or

6.5.3. does not infringe the rights of any third party.

7. How we may use information you provide through the Chatbot

7.1. Information submitted through the Chatbot, including conversation content, may be monitored, recorded, stored and reviewed by us and our service providers for purposes including operating, maintaining, improving, testing, securing and supporting the Chatbot.

7.2. You should not submit sensitive, confidential or unnecessary personal information through the Chatbot.

7.3. We will process personal data in accordance with our Privacy Policy.

 

8. Third party links

8.1. The Chatbot may contain links to third party websites or resources.

8.2. These links are provided for information only. We have no control over those sites or resources and accept no responsibility for them.

 

9. Security

9.1. We do not guarantee that the Chatbot will be secure or free from bugs, viruses or other harmful components.

9.2. You are responsible for using appropriate security and virus protection software and measures.

9.3. You must not misuse the Chatbot by knowingly introducing viruses or other malicious material.

 

10. Our responsibility for loss or damage

10.1. Nothing in these terms excludes or limits our liability for any liability which cannot be lawfully limited, including:

10.1.1. death or personal injury caused by our negligence; or

10.1.2. fraud or fraudulent misrepresentation.

10.2. Notwithstanding clause 10.1, the Chatbot is provided on an “as is” basis and we shall not be liable for any loss or damage arising from:

10.2.1. use of, or inability to use, the Chatbot;

10.2.2. reliance on any output generated by the Chatbot;

10.2.3. any information submitted by you to the Chatbot;

10.2.4. third party websites, resources or services linked to or used in connection with the Chatbot; or

10.2.5. misuse of equipment or failure to follow safety procedures, warnings, training or manuals.

10.3. To the fullest extent permitted by law, we exclude all implied terms, conditions, warranties and representations, including any implied terms as to accuracy, completeness, satisfactory qualify and fitness for a particular purpose.

 

11. No duty to update

11.1. We are under no obligation to update, correct or maintain the Chatbot or any output generated by it.

11.2. Information made available through the Chatbot may not reflect the most current product documentation, specifications or guidance. The applicable manual, warning labels, training materials and direct support from PurPak remain the authoritative sources.

 

12. Governing law

12.1. These terms are governed by the laws of England and Wales.

12.2. The courts of England and Wales shall have exclusive jurisdiction.
